These Civil Miscellaneous Petition has been filed seeking to accept the cause title of the petitioner in the above second appeal.

2. Today, when the matter taken up for hearing, Mr.S.Nambi Arooran, learned counsel for petitioners appeared and there is no representation on the side of respondents. The learned counsel for petitioners submitted that after the disposal of first appeal on 25.03.2024 and before filing the present Second Appeal, the 1st appellant in the A.S.No.17 of 2022 died on 06.07.2024 leaving behind her sons and daughter viz., appellants 1 to 3 herein as her legal heirs. Hence, it is just and necessary to file the present petition praying to accept the cause title.

3. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit as justifiable one, this petition is allowed without prejudice to the contentions of respondents. Registry is directed to carry out necessary amendment in the cause title and to number the above Second Appeal it is otherwise found to be in order.

4. Post the matter on 05.11.2024.
