2. When the matter came up for hearing on 07.11.2023, the learned counsel for the appellant filed a memo reporting no instruction. Recording the said memo, the Registry was directed to remove the name of learned counsel for the appellant and list the matter under the caption "for dismissal" today (08.11.2023), by printing name of the appellant.
3. Today (08.11.2023), when the matter is taken up for hearing, there is no representation for the appellant, in spite of the fact the name of the sole appellant is printed in the cause list. Hence, the second appeal stands dismissed for default. No costs.
