ORDER
The petitioner is the respondent in HMOP. No.268 of 2023, pending on the file of the Additional Sub Court, Tenkasi, seeks transfer to the Family Court, Chennai.
2. The petitioner has stated that her residence is at Saidapet, Chennai and
she has expressed the difficulties to attend the hearing before the Sub Court, Tenkasi and therefore, sought for transfer. It is also an admitted fact that the minor child is in the custody of the petitioner wife.
3. The learned counsel for the respondent husband would fairly submit that insofar as the request to transfer, denying the allegations made in the petition. However, the respondent has no serious objection to the request made by the petitioner.
4. In the light of the above, the HMOP. No.268 of 2023, is withdrawn from the learned Additional Sub Judge, Tenkasi and transfer to the file of the Principal Family Court, Chennai. The Principal Family Court, Chennai shall take up the OP on transfer by itself or transfer to any of the Additional Family Court subject to the pendency of cases before it.
5. With the above direction, the transfer CMP. is allowed. No costs. Consequently, connected miscellaneous petition is closed. 03-07-2025 Rli
