Sub Application Nos.805 & 806 of 2024 in Cont.P.No.1985 of 2024 N.ANAND VENKATESH,J Pursuant to the order dated 13.8.2024, the above two applications have been filed by the applicant/contemnor. Sub.A.No.805 of 2024 has been filed seeking to dispense with the personal appearnace of the applicant. An affidavit has also been filed explaining the reasons as to why such delay had occasioned.

2. Sub.A.No.806 of 2024 has been filed to recall the order dated 13.8.2024.

3. When the matter is taken up for hearing, Mr.S. Sethuramavarma, Controller of Examinations, Teachers Recruitment Board is present before this Court.

4. The learned counsel for the petitioners in the contempt petition submitted that the second petitioner has already submitted the equivalence Government Order at the time of certificate verification and therefore, the respondent/contemnor cannot again insist for the production of equivalence Government Order. substantiate the same, the learned counsel has produced a copy of the acknowledgement that was given while submitting the documents during certificate verification on 18.7.2022.

5. In so far as the first petitioner in the contempt petition is concerned, the learned counsel appearing for the petitioners submitted that there is a letter dated 09.12.2019 issued by the authority concerned, which has recognized the equivalence of the M.E. degree possessed by the first petitioner in the contempt petition.

6. This Court is not inclined to withdraw the earlier order dated 13.8.2024. However, the personal appearance of the respondent/contemnor is dispensed with. Both the subapplications are disposed of accordingly.

7. A copy of the letter dated 09.12.2019 relied upon by the learned counsel for the petitioners in the contempt petition with respect to the first petitioner shall be handed over to the learned Additional Advocate General appearing on behalf of the respondent/ contemner immediately. The learned Additional Advocate General shall take instructions with respect to the stand taken by the petitioners in 2/4

the contempt petition and report the same to this Court on the next date of hearing.

8. Post the contempt petition for orders on 10.9.2024 at 2.15 PM.
