The petitioner, who is the sole accused, was arrested and remanded to judicial custody on 23.01.2016 for an alleged offence punishable under Section 366-A of IPC and subsequently altered into Section 5[1] r/w 6 of Protection of Children from Sexual Offences Act, 2012 in Crime No.1277 of 2015 on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that on 12.12.2015, the petitioner kidnapped the victim, who is aged about 17 years, resulting in the registration of the case.

3.Learned counsel appearing for the petitioner would submit that both the petitioner and the alleged victim have fallen in love with each other and due to family dispute, the alleged victim left her house and on 12.12.2015, she voluntarily joined with the petitioner and subsequently, a false complaint has been given by her mother against the petitioner. 4.Per contra, learned Government Advocate [Criminal Side] appearing for the respondent would submit that the petitioner kidnapped the victim, aged about 17 years and now she is secured and handed over to her parents. It is further submitted that major part of the investigation is over.

sri 5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for Rs.10,000/- [Rupees Ten Thousand only] with two sureties each for a like sum, to the satisfaction of the learned First Additional District and Sessions Judge, Full Additional Charge of the Magalir Neethimandram [Fast Track Mahila Court], Tiruppur and on further condition that the petitioner shall report before the respondent police daily at 10.00a.m. until further orders. 15.03.2016 sri Crl.O.P.No.4888 of 2016
