ORDER

This Criminal Original Petition has been filed to direct the first respondent to give police protection to the petitioner by considering the representation dated 29.09.2022.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

The learned counsel for the petitioner has submitted that the petitioner was residing in Thorakavadi Village, Thittakudi Taluk, Cuddalore District; he acquired the property in S.No.184/2 situated at Vadasiruvalur Village, Cuddalore District by virtue of a sale deed dated 05.09.2019 and he continued to be in possession and enjoyment of the same; patta has also been granted in his name in Patta No.1724 and he has been paying the land tax periodically; on 03.07.2022, he made an application to the respondents to survey his land comprised in S.No.184/2 and that was considered and in view of that, the District Collector issued a proceedings dated 24.07.2022 to the Tahsildar, Thittakudi; after making due enquiry, the Tahsildar has issued an order vide his proceedings in

Na.Ka.Vu/FL797/2022 dated 07.09.2022 and requested the third respondent police to provide appropriate police protection to survey the land on 20.09.2022; since police protection was not given, the property cannot be surveyed; therefore, the petitioner is before this Court.

Since the Tahsildar, Thittakudi himself has given a proceedings to the third respondent police to provide police protection, anticipating any law and order issues, the third respondent ought to have considered the same and done the needful. On 29.09.2022 also the petitioner himself had given a representation seeking police protection. The third respondent police has not passed any orders on the said representation so far. Hence the third respondent is directed to consider the same and pass necessary orders taking into consideration the ground realities and all other circumstances.

5. With the above observations, this Criminal Original Petition is disposed.
