O R D E R

The petitioner has come forward with this petition seeking for a direction to the respondent police to register a case pertaining to the petitioner's complaint dated 10.02.2016. 2.The learned counsel for the petitioner submitted that the petitioner has lodged a complaint before the respondent on 10.02.2016, for which, C.S.R.No.79 of 2016 has been assigned. But the respondent has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief.

3. At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that on the basis of the complaint given by the petitioner, petition enquiry in C.S.R.No.79 of 2016 has been conducted, statement of the petitioner has been recorded and the complaint was closed on 11.02.2016 as it is civil in nature. Hence, he prayed for dismissal of the petition.

4. Considered the rival submissions made on both sides and perused the typed set of papers.

5. The petitioner, who is the complainant, was one of the partner in M/s.Glorious Security Service in Ambattur, Chennai. He had initially invested Rs.1,50,000/-. Since the other partners have obtained wrongful gain, the petitioner has given a complaint. After due enquiry, the complaint was closed since it is civil in nature. Hence, the Criminal Original Petition is closed. However, the petitioner is at liberty to approach the appropriate forum to workout his remedy in the manner known to law.
