The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 147, 148, 294(b), 324 and 307 of IPC and Section 3(1) of PDPP Act, in Crime No.247 of 2023, on the file of the respondent police seek anticipatory bail.
2. The case of the prosecution is that there was land dispute between the defacto complainant's family and the petitioners family, due to which, on 08.08.2023 at about 09.30 hours, while the defacto complainant was taking along with his father, elder brother, younger brother and cousin near Mariyamman Temple, the petitioners along with other accused abused them in filthy language and assaulted them with steel rod and wooden log and broke the rear glass of the defacto complainant's car. Hence, the complaint.
3. The learned counsel for the petitioners would submit that the
petitioners are innocent persons and they have been falsely implicated in this case and due to land dispute, a false complaint has been foisted against the petitioners. He would further submit that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl. Side) for the respondent submitted that due to land dispute existing between the defacto complainant and the petitioners, the petitioners along with other accused abused the defacto complainant and his family members in filthy language and assaulted them with steel rod and wooden log and thereby three persons have been injured. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
5. Heard the learned counsel for the petitioners and the learned Government Advocate and perused the materials available on record.
6. Considering the nature and gravity of offence committed by
the petitioners and the matter is under investigation and taking into consideration the overt act of the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the criminal original petition is dismissed.
