ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the 3rd Respondent to release the document P 34 of 2006 pending on their file.

2. The learned counsel appearing for the petitioner would submit that when a gift deed was represented for registration by one Kamalakshmi in favour of the petitioner's Trust as early as on 20.09.2006, the same was kept pending as Document No.P34 of 2006. Subsequently, the said Kamalakshmi presented a cancellation deed dated 24.11.2006 seeking cancellation of the said deed and the same was also kept pending under Document No.P37 of 2006 on the file of the 3rd respondent. Hence, the present writ petition is filed.

3. The learned Government Advocate appearing for the respondents would submit that since 47-A proceedings are pending, the respondents are not in a position to register the same however, if any direction is issued, the same will be considered by the respondents.

4. Heard the learned counsel appearing for the petitioner as well as the respondents and perused the material available on record.

In view of the submissions made by the learned counsel appearing on either side, this Court is of the considered view that even the 47-A proceedings are pending, there is no impediment for the Sub-Registrar to register the gift deed as well as the cancellation deed therefore, the 3rd respondent is directed to register the gift deed dated 20.09.2006 in pending Document No.P34 of 2006 as well as the cancellation deed dated 24.11.2006 in pending Document No.P37 of 2006 within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that the same will be subject to outcome of the 47-A proceedings.
