ORDER

The petitioner has filed this contempt petition to punish the respondent for disobeying the order of this Court dated 07.12.2023 passed in W.P.No.33926 of 2023.

2.When the matter is taken up for hearing, it is informed by the learned Special Government Pleader appearing for the respondent that the order of this Court dated 07.12.2023 passed in W.P.No.33926 of 2023 has been complied with. He has also filed the copy of the order dated 10.08.2024 passed by the respondent on the petitioner's representation.

3. Learned counsel for the petitioner submitted that this Court vide order dated 07.12.2023 in W.P.No.33926 of 2023, had directed the fourth respondent therein/respondent herein to consider the petitioner's representation dated 14.08.2023 and to issue notice to the petitioner and the adjacent land owners, rival claimants/interested parties, if any, and conduct enquiry in the manner known to law and to pass orders on merits and in accordance with law. Whereas, neither opportunity was given to

the petitioner nor enquiry was conducted and order of this Court has not been duly complied with.

4.It is stated by the learned Special Government Pleader that order of this Court has been complied with. The grievance of the petitioner is that opportunity was not given to him. If the petitioner is aggrieved with the order passed by the respondent herein, he is at liberty to challenge the order passed by the respondent by way of filing Certiorarified Mandamus Petition.
