This petition is filed for modification to modify the condition imposed by this Court in Crl.O.P.No.21138 of 2022 dated 02.09.2022.
2. The petitioners were granted anticipatory bail in crime No.95 of 2022 registered for the offence under Sections 9 and 10 of Prohibition of Child Marriage Act, 2006 in Crl.O.P.No.21138 of 2022 order dated 02.09.2022 with the condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only), with two blood sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Kodumudi, Erode.
3. The learned Counsel for the petitioners would submit that the petitioners 3 and 4 do not have blood related sureties and the petitioners 1 and 2 have only one blood relative. Therefore, he seeks modification of the condition imposed by this Court in Crl.O.P.No.21138 of 2022 dated 02.09.2022.
4. Considering the facts and circumstances of the case, this Court is inclined to modify the conditions imposed by this Court. The conditions to be modified in Crl.O.P.No.21138 of 2022 are read as follows:
"7. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate, Kodumudi, Erode District on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition ...."
5. All other conditions remain unaltered. Accordingly, this Criminal Miscellaneous Petition is ordered. Further, time already granted by this Court in Crl.OP.No.21138 of 2022 dated 02.09.2022 is extended till 20.10.2022, failing which, the anticipatory bail shall stands automatically cancelled. 11.10.2022 Anu G.K.ILANTHIRAIYAN , J.
