Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of certiorarified mandamus to call for the records pertaining to the order passed by the third respondent in Na.Ka.S-1/6525/2015 dated 11.08.2016 and the consequential order passed by the second respondent in Muu.Mu.K1/13040/2016 dated 09.09.2016 and quash the same and direct the respondents to affix the Renewal Slip in the Ration Card for the petitioner bearing No.07/G/0552061, so as to enable the petitioner to get commodities, supplied by the Civil Supplies Department. O R D E R

The petitioner is aggrieved against the order passed by the second and third respondents, rejecting the request of the petitioner for annexing the additional sheets in the Ration card referred to as R.C.No.07/G/0552061 on the reason that the said card stands in the name of another person by name Kathavarayan. Another reason set out in the impugned order is that the petitioner was not residing in the property, for which he is seeking Ration Card.

2.Heard both sides.

3.Though a counter affidavit is filed and opposed the present writ petition, the learned Special Government Pleader fair enough to state that the petitioner may be directed to apply for issuance of fresh ration card with relevant material documents in support of such claim and also in support of proof of address and as and when such application is filed, the same will be considered and orders will be passed without loss of further time.

4.Considering the above stated facts and circumstances and in view of the statement made by the learned Special Government Pleader, this writ petition is disposed of, by directing the petitioner to give a fresh application with relevant material documents in support of his claim within a period of two weeks from the date of receipt of copy of this order. On receipt of such application, the third respondent shall consider the same and pass necessary orders within a period of six weeks thereafter independently without reference to the earlier orders passed, which are impugned in this writ petition. No costs.
