ORDER
The present writ petition has been filed for the issue of a writ of mandamus directing the 1 st respondent to re-issue the passport of the petitioner by accepting the corrected birth certificate issued by the Office of the Sub Registrar, Jalakandapuram, Mettur Taluk, Salem District and record the date of birth as 20.12.2001.
2. Heard Mr.N.Sathish Babu, the learned counsel for the petitioner and Mr.A.Poornachandran, learned Central Government Standing Counsel for the 1 st respondent and Mr.V.Meganathan, the learned Government Advocate (Crl side) for the 2 nd respondent.
3. The learned Government Advocate appearing on behalf of the 2 nd respondent, on instructions, submitted that there is no criminal case pending against the petitioner.
4. The learned Central Government Standing Counsel appearing on behalf of the 1 st respondent submitted that initially a passport was issued to the petitioner by showing the date of birth as 20.05.2001. This date of birth was
recorded in the passport based on the birth certificate that was issued by the Tiruchirapalli City Corporation. However, when the petitioner submitted the application for re-issuance of passport, the petitioner wanted the date of birth to be changed as 20.12.2001 based on the birth certificate issued by the Sub Registrar, Jalakandapuram, Mettur Taluk, Salem District. The same is under consideration before the 1 st respondent.
5. In the considered view of this Court, the date of birth of the petitioner was entered in the passport based on the earlier birth certificate issued by the Tiruchirapalli City Corporation. Subsequently, it was found that the said date of birth was wrongly entered and an application was submitted along with the relevant documents and based on which the fresh birth certificate has been issued by the concerned authorities by showing the date of birth of the petitioner as 20.12.2001. The petitioner wants the passport to be reissued by incorporating the correct date of birth.
6. In view of the same, the 1 st respondent shall ascertain from the Sub Registrar, Jalakandapuram, Mettur Taluk, Salem District on the genuineness of the date of birth certificate. If the same is found to be genuine, the application submitted by the petitioner has to be processed and the correct date of birth has to be incorporated in the passport and the passport should be reissued / renewed in favour of the petitioner. This process shall be completed by the 1 st respondent within a period of four weeks from the date of receipt of a copy of this order.
This writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed.
