Respondents Prayer:- Writ Petition is filed, under the Article 226 of Constitution of India, to issue a Writ of Mandamus directing the respondents to settle the superannuation amount of Rs.2,19,653/- due to the petitioner received and retained in Ambur Cooperative Sugar Mills Superannuation Trust account with Vellore Central Cooperative Bank, Ambur Sugar Mills Branch in March 2006 along with accrued interest at the rate of 18 percentage per annum from March 2006 till date of payment to petitioner 1/5

in consideration of representation lastly submitted on 27.07.2022 within a time frame to be fixed by this Court.

ORDER

This Writ Petition has been filed to direct the respondents to settle the superannuation amount of Rs.2,19,653/- due to the petitioner received and retained in Ambur Cooperative Sugar Mills Superannuation Trust account with Vellore Central Cooperative Bank, Ambur Sugar Mills Branch in March 2006 along with accrued interest at the rate of 18 percentage per annum from March 2006 till date of payment to petitioner in consideration of representation lastly submitted on 27.07.2022 within a time frame to be fixed by this Court.

The grievance of the writ petitioner is that despite the recommendation of the first respondent to release the terminal benefits of the petitioner, the same has not been released by the second respondent. In this regard the petitioner has given a representation to the respondent on 27.07.2022. However, the same has not been considered by the respondents. Hence, the present Writ Petition.

3. Mr.P.Baladhandayutham, Special Government Pleader takes notice for the first respondents and Mr.A.Edwin Prabhakar, Special Government Pleader takes notice for the second respondent

A perusal of the typed set filed by the petitioner indicate that infact by a letter dated 22.02.2021, the first respondent has recommended to release the terminal benefits of the petitioner after deducting a sum of Rs.12,512/-. However, the second respondent kept the matter pending. In such view of the matter, the second respondent is directed to pass Orders on the representation of the petitioner 27.07.2022 taking note of the recommendation of the first respondent and release the 3/5

terminal benefits to the petitioner within a period of one month from the date of receipt of a copy of this Order.

5. With the above direction, this Writ Petition is disposed of. No costs.
