This application is filed by the second defendant in the suit. The suit is at the trial stage and P.W.1 has been examined in full. 2. Learned counsel for the applicant / second defendant submits that a power of attorney was given by the first defendant to the plaintiff and subsequently cancelled. According to learned counsel, this document is relevant to the second defendant's defence in the suit. Learned counsel for the plaintiff opposes the application on the ground that the second defendant is not a party to the document.

3. The suit has been filed for recovery of amounts allegedly due and payable to the plaintiff in relation to services rendered for identifying buyers for the lands of the first defendant. The document sought to be filed appears prima facie to be relevant. Therefore, subject to the right of the plaintiff to file an affidavit of admission / denial and raise objections inter alia on the grounds of admissibility, relevance and proof, this application is liable to be and is hereby allowed.
