Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 & 2 to survey the land and demarcate the boundaries of the petitioner's plot bearing No.347, comprised in Paimash No.1257/4 corresponding to Survey Nos.37/2&3 Part and 137/3, measuring to an extent of 4800sq.ft. in K.Plan Extension Lay-out in South Area, Kubera Nagar Extension in Madipakkam Village, Sholinganallur 1/5

The petitioner herein seeks a direction to the respondents 1 & 2 to survey the land and demarcate the boundaries of the petitioner's plot bearing No.347, comprised in Paimash No.1257/4 corresponding to Survey Nos.37/2&3 Part and 137/3, measuring to an extent of 4800 sq.ft. in K.Plan Extension Lay-out in South Area, Kubera Nagar Extension in Madipakkam Village, Sholinganallur Taluk, Chengalpattu District, pursuant to the petitioner's application dated 12.08.2024 along with remittance of necessary fee vide Challan No.20240628002458 and to issue patta in favour of the petitioner.

2. The petitioner herein applied for transfer of patta for the above mentioned property based on sale deed dated 27.11.1995. Since there was some discrepancy with regard to the extent on ground, the petitioner filed an on-line application dated 28.06.2024 seeking survey of the land. The said application has not been considered till date. Therefore, the petitioner is before this Court.

3. Mr.U.Baranidaran, learned Additional Government Pleader, who takes notice for the respondents 1 & 2 would submit that the on line application of the petitioner for survey of land will be considered on its own merits and appropriate orders will be passed.

4. In view of the above submission of the learned Additional Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the first respondent to consider the on-line application of the petitioner dated 28.06.2024 vide Challan No.20240628002458 and pass final orders, after issuing notice to all interested parties, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
