This Civil Miscellaneous Petition has been filed seeking to set aside the dismissal order and restore C.R.P.No.1758 of 2023, which was dismissed for default by this Court on 14.08.2024.

2. Learned counsel appearing for the petitioner submitted that the civil revision petition has been filed against the order passed by the II Additional Principal Family Court, Chennai, in E.P.No.23 of 2023 in O.P.No.322 of 2021 dated 28.04.2023. He further submitted that the petitioner had also filed an another revision petition in C.R.P.No.4015 of 2023 against the order passed in I.A.No.2 of 2022 in O.P.No.322 of 2021 dated 16.02.2023 on the file of the same court and pending the revision petition, the matter has been compromised between the petitioner/husband and the respondent/wife and they have also entered into a settlement agreement. Therefore, he seeks permission of this Court to withdraw the present petition and he has also made an endorsement to that effect.

3. Recording the submission made by the learned counsel appearing for the petitioner and considering the endorsement made by him, this Civil Miscellaneous Petition stands dismissed as withdrawn.
