ORDER

(1)Mr.R.Thamaraiselvan, learned Special Government Pleader accepts notice on behalf of the respondent. With the consent of both the learned counsels, the main writ petition is taken up for final disposal at the admission stage. (2)The writ petition is filed for a mandamus directing the respondents to consider the petitioner's representation dated 04.03.2025 and consequently to direct the respondent to settle the claim of the petitioner in respect of the balance amount available in the Bank Account of late Mr.M.Ganesan and hand over 34.5 grams of gold jewels from the respondent Bank, Nanganallur Branch.

(3)The petitioner as the legal heir of her father, Mr.M.Ganesan, has filed the above writ petition for the aforesaid relief. (4)The petitioner states that her father Mr.M,Ganesan, was maintaining a Savings Bank Account in Kanchipuram Central Cooperative Bank at Nanganallur Branch, in Account No.1065. The petitioner's father mortgaged jewels of about 34.5 grams with the respondent Bank. The petitioner states

that she discharged the entire loan amount. Since her father died on 22.08.2008, as the rightful legal heir, she requested the respondent Bank to return the balance amount lying in the Savings Bank Account of her father as well as the jewels weighing about 34.5 grams. The petitioner produced necessary Death Certificate and the Legal Heirship Certificate to the authorities concerned in support of her claim to the aforesaid property. Despite the petitioner's repeated requests, no action was taken and therefore, the petitioner submitted a representation on 10.07.2015, and subsequently, submitted multiple representations. As no action was taken, the petitioner sent a further representation on 04.03.2025, and even thereafter, no action was taken and therefore, the petitioner was constrained to file the above writ petition for the aforesaid relief.

(5)The learned counsel for the petitioner submitted that it would be suffice if a direction is issued to the respondent Bank to consider the petitioner's representation dated 04.03.2025,within a time frame to be fixed by this Court. (6)Heard the learned counsels on either side and also perused the materials placed on record.

(7)Under the facts and circumstances of the case and in the light of the limited prayer of the learned counsel for the petitioner, a direction is issued to the respondent Bank to consider and dispose of the petitioner's representation dated 04.03.2025 on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. (8)The writ petition is disposed of with the above direction.
