Respondent Prayer: Criminal Original Petition is filed under Section 439(1) (b) of Cr.P.C. to modify the following conditions that one surety shall be a blood relatives and other surety shall possess immovable property and produce the proof of residence and produce the title deed of document for verification which have been imposed on him by the learned Judicial Magistrate No.I, Poonamallee, Thiruvallur District in C.M.P.No.614 of 2016 by order dated 08.02.2016.

O R D E R

The petitioner has come forward with this petition for modification of the condition imposed while he as enlarged on bail by an order dated 08.02.2016 in Crl.M.P.No.614 of 2016 by the learned Judicial Magistrate No.I, Poonamallee.

2. The learned counsel for the petitioner submitted that at the time of granting bail to the petitioner, the learned Judicial Magistrate imposed two conditions, i.e., the petitioner shall execute a bond for Rs.10,000/- together with two sureties each for a likesum, one surety shall be a blood relatives and the other surety shall possess immovable property and produce https://hcservices.ecourts.gov.in/hcservices/

the proof of residence and produce the title deed of document for verification. He further stated that at the time of executing the bond, the surety of his mother and his wife were refused by the learned Magistrate stating that they are not having Family Card. Hence, the surety of his mother or his wife may be accepted on production of their necessary Identity proof.

3. Considering the submissions of the learned counsel for the petitioner, this Court directs the learned Judicial Magistrate No.I, Poonamallee, to accept the surety of the mother or wife of the petitioner, for blood relative surety, on their production of Identity Proof and passport, if otherwise in order.
