This Criminal Miscellaneous Petition has been filed seeking to suspend the sentence imposed on the petitioner vide judgement dated 27.06.2023 in S.C.No.120 of 2018 by the Principal Sessions Judge, Tiruppur and enlarge the petitioner on bail, pending disposal of the appeal.
2. The deposition of P.W.2 and P.W.3 amplifies the occurrence. The documents marked are also corroborating and therefore, we do not find any primafacie reason to consider the petitioner to the suspend the sentence. However, the other ground raised on merits deserves further adjudication during the course of hearing of the Criminal Appeal.
3. Accordingly, the Criminal Miscellaneous Petition stands dismissed. List the Criminal Appeal after three weeks.
