PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to call for the records and quash the proceedings in Crime No.268 of 2019 pending on the file of the respondent police.

O R D E R

The learned counsel for the petitioner submits that the petitioner, who has been arrayed as second accused, is innocent and no way connected with the occurrence. According to him, the licence for the quarry had expired and he had also handed over the trip sheets to the concerned authorities. In my view, such details can be established during the course of trial and this Court may not be justified in subjecting into the issues of the Investigation Officer. Nevertheless, if the investigation by the 2nd respondent herein is directed to monitor by the Superior Officer, the ends of justice could be secured.

In the light of the observation, there shall be a direction to the first respondent to complete the investigation in Crime No. 268 of 2019 as expeditiously as possible, in any event, within a period of eight weeks from the date of receipt of copy of this order. Such an investigation shall be monitored https://hcservices.ecourts.gov.in/hcservices/

by the Deputy Superintendent of Police having territorial jurisdiction over the respondent herein on a day to day basis. This Criminal Original Petition stands disposed of accordingly. Consequently, connected Criminal Miscellaneous Petition is closed.
