ORDER
The writ petitioner seeks a direction to the respondents to consider the
petitioners representation dated 22.02.2024 to appoint the petitioner and 4 other persons as administration committee for Ali Shan Wakf G.S.No.301/Chennai in accordance with law.
2. It is the case of the petitioner that originally in the year 1960, one Faizuddin Sahib was appointed as Muthawalli for the above wakf and after his demise, no proper person has taken administration for the above said wakf. Under these circumstances, the petitioner and others have made a representation before the respondents since they are interested person under Section 3(k) of Wakf Act to appoint him and others as committee members for a period of three years and the same has not been considered. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass appropriate orders on the petitioner's representation within the stipulated time as fixed by this Court.
4. The learned Standing Counsel appearing for the respondents submitted that the representation will be considered and an appropriate orders will be passed within the time frame as fixed by this Court.
5. Heard the learned counsel for the petitioner as well as the learned Standing Counsel and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the 3rd respondent to consider the petitioner's representation dated 22.02.2024 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
