PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondents 1 and 2 to provide police protection to the factory premises of the petitioner and also to ensure that no protests or other activities of the 3rd respondent be carried out within the radius of 500 mts from the gate of the petitioner Company.

O R D E R

The petitioner company is engaged in manufacturing of Monofilament and multifilament products. The 3rd respondent is a Trade union namely, the Gummidipoondi SIPCOT / & Engineering Workers Union consisting of 78 employees of the petitioner company. On account of industrial dispute between the petitioner and the 3rd respondent Union, the 3rd respondent Union, without giving prior intimation to the petitioner company, indulged in staging Dharna infront of the gate of the factory premises of petitioner company on 12.12.2023 and 12.01.2024. Due to the action of

the 3rd respondent Union, free ingress and egress of men and material to the factory premises were disturbed and the same created law and order problems also. Hence, the petitioner made a representation before the 1st respondent on 03.06.2024 and 08.07.2024 seeking to provide police protection to the factory premises of the company, but since no action has been taken by the 1st respondent, the petitioner has filed the present writ petition.

2. The learned counsel appearing for the 3rd respondent submitted that already the strike had been withdrawn by the 3rd respondent Union.

3. However, the learned counsel for the petitioner submitted that though the strike was withdrawn by the 3rd respondent, normalcy was not yet restored within the factory premises.

4. In view of the above, the 1st respondent is directed to grant police protection on the complaint, if any, lodged by the petitioner on fresh cause of action, to the factory premises of the petitioner. On receipt of such complaint, the 1st respondent shall ensure that no protest or any other activities of the 3rd respondent Union be carried out within the

radius of 200 meters from the petitioner's factory premises.
