O R D E R

The petitioner has come forward with this petition seeking for a direction to the respondents 1 and 2 to register the complaint and record FIR on the complaint made by the petitioner herein to second respondent on 07.01.2016.

2.The learned counsel for the petitioner submitted that the petitioner has lodged a complaint before the second respondent on 07.01.2016 stating that the counter petitioner as the owner of the property entered into a sale agreement with the petitioner and he has also received Rs.12 lakhs through his power agent, but he has refused to execute the sale deed. But the second respondent has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief. https://hcservices.ecourts.gov.in/hcservices/

3.At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that on the basis of the complaint given by the petitioner, C.S.R.No.16 of 2016 has been assigned and the same was closed. He further submitted that since the counter petitioner denied the receipt of money, the petitioner was directed to approach the Civil Court to work out his remedy.
