ORDER
The petitioner who was arrested and remanded to judicial custody on 11.03.2025 for the offence punishable under Section 392 I.P.C. in Cr.No.164 of 2012 registered on the file of the respondent, seeks bail.
2.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has been already released on bail and in this case charge sheet has been filed in C.C.No.196 of 2013 and petitioner has regularly appeared for all the hearings. Due to his ill health, he could not able to attend the court on 30.06.2014 and hence NBW was issued against the petitioner and the same was executed on 11.03.2025. Hence, he prayed for grant of bail to the petitioner.
3.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that investigation has been completed and charge sheet has been filed in C.C.No.196 of 2013. He contended that for the past ten years, the petitioner was absconding and that on the hearing date the petitioner has not appeared before the trial Court and hence NBW was issued against this petitioner on 12.07.2022 and the same was executed after three years on 11.03.2025. The case is of the year 2012 and it has been kept pending for almost thirteen years because of the petitioner's absconding. So far five witnesses have been examined and there are only few more witnesses to complete the trial. Hence, opposed for grant of bail to the petitioner. 4.Heard the learned counsels on either side and perused the materials on record.
5.Considering the facts and circumstances of the case, the submission of learned counsels on either side and since custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
