This Original Petition has been filed under sections 222 and 276 of the Indian Succession Act, 1925 seeking probate of the last Will of Dr. M.S.Ramachandran, who died on 23.09.2021. He left behind a Will dated 03.10.2019. The 1st respondent is his wife. The petitioner is the Executrix of the Will and also one of the beneficiaries under the Will and niece of Dr. M.S.Ramachandran. The 2nd, 3rd and 4th respondents are also nephew and niece of Dr. M.S.Ramachandran and they are also beneficiaries under the Will. Life interest has been granted to the 1st respondent. The respondents had given their consent affidavits.

2. During evidence, the petitioner examined herself as PW-1. The original Will dated 03.10.2019 was marked as Ex.P1. The death certificate of Dr. M.S.Ramachandran and his legal heirship certificate were marked as Ex.P2 and Ex.P3. The consent affidavits of the respondents were marked as Ex. P4 to Ex.P7.

3. To further prove the Will, R.Sundar, one of the attesting witnesses was examined as PW-2. He identified the Will and also his signature in the 1/3

Will and also the signature of Dr. M.S.Ramachandran and also the signature of R.Kalavathy and the other attesting witnesses. He specifically stated the Testator signed the Will in their presence and the Executrix including himself signed the Will in the presence of the Testator. It is specifically stated that the Testator was in a sound and deposing state of mind at the time of execution of the Will.

4. In view of the evidence produced, the probate of the Will is granted as prayed. This Original Petition stands allowed. 21.09.2022 Maya 2/3
