PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records pertaining to the charge sheet in C.C.No.3643 of 2015 on the file of the IX Metropolitan Magistrate Court, Saidapet, Chennai and quash the same in respect of the petitioners/accused are concerned.

This Criminal Original Petition is filed to call for the records pertaining to the charge sheet in C.C.No.3643 of 2015 on the file of the IX Metropolitan Magistrate Court, Saidapet, Chennai and quash the same.

2. It is stated by the learned counsel for the petitioners that pending the criminal complaints against the 1st petitioner herein, the parties have amicably resolved the disputes among themselves and have also filed a petition seeking for a divorce on mutual consent before the learned II Additional Family Court, Chennai in HMOP.No.4272 of 2014.

3. As per the terms and conditions in the mutual consent divorce petition, the 1st petitioner submits that they do not want to pursue with the criminal case in C.C.No.3643 of 1015, which is now pending before the learned IX Metropolitan Magistrate, Saidapet, Chennai. The 2nd respondent has also filed a consent affidavit before this Court dated 09.09.2019 to this effect.

4. Recording the statements made in the consent affidavit filed by the 2nd respondent herein dated 09.09.2019, the proceedings in C.C.No.3643 of 2015, pending on the file of the learned IX Metropolitan Magistrate, Saidapet, Chennai, is quashed.

5. The Criminal Original Petition stands disposed of accordingly. Consequently, connected miscellaneous petition is closed.
