Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents, particularly the first respondent to dispose of the petitioner's appeal against the order of the second respondent dated 21.07.2024 in Survey No.123/6, 123/3, 125/6, at Kodanagar, Gandhi Salai, Thiruvathipuram, Cheyyar Taluk, Thiruvannamalai District, to an extent of 54037 square feet and to grant a patta in favour of the petitioner.

O R D E R

The petitioner herein seeks a direction to the first respondent to dispose of his appeal pending on the file of the first respondent filed against the order passed by the second respondent dated 21.07.2024 seeking issue of patta in respect of land in S.Nos.123/6, 123/3 & 125/6 at Kodanagar, Gandhi Salai, Thiruvathipuram, Cheyyar Taluk, Tiruvannamalai District.

It is the case of the petitioner that he submitted an application seeking issue of patta in respect of the above mentioned land before the second respondent and the same was rejected by his order dated 21.07.2024. Challenging the rejection order, the petitioner filed an appeal before the first respondent on 30.07.2024 and the same is pending on the file of the first respondent till date.

Mr.U.Baranidaran, learned Additional Government Pleader, who takes notice for the respondents 1 & 2 would submit that the appeal of the petitioner was submitted through registered post only on 30.07.2024 and the same will be considered in accordance with law, within a time frame fixed by this Court.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the first respondent to consider the appeal filed by the petitioner dated 30.07.2024 and pass final orders, within a period of 12 weeks from the date of receipt of copy of this order, in accordance with law.

5. With the above direction, this Writ Petition is disposed of. No costs.
