The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 6(4) Tamil Nadu Schedule Commodities (RDCS) order 1982 r/w. Section 7(1)(a)(ii) of the Essential Commodities Act, 1955 in Crime No.126 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with another accused were found in illegal possession of 100 Kgs of PDS rice. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has not committed any such offence as alleged by the prosecution and she has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that there are totally 2 accused in which the petitioner is arrayed as A2. The petitioner along with another accused were found in illegal possession of 100 Kgs of PDS rice. He would further submit that there are four previous cases similar in nature against the petitioner. The earlier anticipatory bail petition in Crl.O.P.No.19684 of 2022 was dismissed by this Court on 22.08.2022. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the gravity of offence committed by the petitioner, there is no change of circumstance in the earlier order passed by this Court. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed with cost to the tune of Rs.5,000/- (Rupees Five Thousand Only) to the credit of the Chief Justice Relief Fund, High Court, Madras. 11.10.2022 Anu 2/3
