Judgment (Judgment of the Court was delivered by S.M.Subramaniam J.) The present intra Court Appeal has been instituted challenging the writ order dated 13.07.2023 made in W.P.No.29083 of 2022.

2. The legal principles governing the process of selection are that the candidates who participated in the process of selection cannot claim selection or appointment as a vested right. The very selection would not confer any right on the candidate to seek appointment. During the process of selection, no right vests with the candidate unless the process of selection is challenged on the ground of legality or violations of any of the provisions of the statutes or rules in force.

3. Pertinently, in the present case, the appellant who is the writ petitioner filed a writ petition challenging the newspaper recruitment notification dated 10.10.2022 and for all consequential directions to publish the result of the interview held on 04.02.2021.

4. The respondents have filed a counter affidavit in the writ petition stating that pursuant to the notification dated 14.12.2020, an interview was conducted. However, the selection process was kept pending for some time due to administrative reasons, mainly due to Covid-19 pandemic. While so, the Government of Tamil Nadu issued guidelines vide letter dated 28.09.2022

to all the District Collectors with respect to selection of Village Assistant. Consequently, earlier notification was called off and a fresh notification was issued on 10.10.2022. Since the subject notification was cancelled by the Government and a fresh notification came to be issued, the appellant cannot seek any relief, based on the recruitment notification which was cancelled.

5. Mere participation in the interview would not confer any right to claim that the result of the interview must be published. The writ Court considered the issue in right perspective and in consonance with the settled legal position. Thus, the Writ Appeal stands dismissed. No costs. (S.M.S.,J.)
