Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the respondents without any preconditions to join the petitioner's Minor son N.T.Sujith from 9 th standard to th standarad in the 2 and 3 rd respondents' school, so as to enable the petitioner's son to study his 10 th standard in the academic year 2024-2025, within a stipulated period of time.

This Writ Petition has been filed seeking for a direction directing the second and third respondents not to stop the education of the petitioner's Minor son N.T.Sujith without any pre-condition and allow him to join in 10 th standard in the second and third respondents' School for the academic year 2024-2025.

2. Heard the learned counsel on either side and perused the materials available on record.
3. It is seen that the petitioner's Minor son N.T.Sujith has studied in the third respondent's School right from his first standard. He had written his th standard examination conducted in the month of April 2025, but he got failed in all subjects. However, the third respondent's School conducted reexamination for said N.T.Sujith alone and he was passed with grace marks. Accordingly, the petitioner's son has scored 35 marks in each subjects with a total of 175 out of 500. While that being so, at the instance of the petitioner, the third respondent issued transfer certificate to said N.T.Sujith.

Now, it is the grievance of the petitioner that under compulsion and coercion of the School Management, his wife signed in the transfer certificate on 09.06.2025 and also paid requisite fees for the same. Having signed in the transfer certificate, the contention of the petitioner that his Page Nos.3/6
wife signed in the transfer certificate under compulsion cannot be accepted. Therefore, the directions sought for in this writ petition cannot be considered and the same are liable to be dismissed.
5. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. However, the first respondent - Director of School Education, Chennai, is hereby directed to accommodate the petitioner's son in 10 th standard in any one of the Government School in and around the petitioner's residence. It is also made clear that the petitioner shall approach nearby Government School for admission of his son in 10 th standard on or before 04.09.2025.
