JUDGMENT
When the matter was taken up for hearing on 15.11.2016, this Court directed the Registry to print the name of the appellant and list the case on 16.11.2016 under the caption "For Dismissal". Today, when the matter is taken up for hearing, the learned counsel for the respondents 1 and 2 are present, but the learned counsel for the appellant is not present, in spite of the case is posted under the caption for dismissal. Hence, this Civil Miscellaneous Appeal is dismissed for non-prosecution. Consequently, the connected miscellaneous petition is closed. No costs.
