ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 24(1) Cigarette and other Tobacco Products Act 2003 and 328 of IPC in Crime No.1508 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that on 01.08.2021 the defacto complainant has given a complaint before the respondent police on the allegation that he is working in a private company at Sendrambakkam Village on 01.08.2021 the defacto complainant as usual buy the Hans from the petitioner in their car which is opposite to Theeyambakkam bus stand, after buying the hans the defacto complainant has had the hans thereafter taking the hans the defacto complainant was got fainted and fell down thereafter the defacto complainant friends has taken the defacto complainant to the hospital and thereby this complaint has been launched before the respondent police. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

The learned Government Advocate (Crl.Side) submitted that no previous case pending against the petitioner, he is used to sell the contraband under the name of Raj Agency and police also recovered the contraband articles which comes near about 90+ and 30 kilos, which needs detailed investigation, if bail is granted the petitioner is absconding. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case and the submission of the learned Government Advocate (Crl. Side), this Court is not inclined to grant anticipatory bail to the petitioner.
