Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 1st respondent to survey and point out the field boundaries of the petitioner's agricultural land in Survey Nos.35/18, 35/15, 35/20 at Gonour West Village, Mettur Taluk, Salem District by fixing stones and subsequently directing the 2nd respondent to provide necessary police protection at the time of survey and setting up the fencing to the petitioner's above said property in pursuant of the petitioner's representation dated 08.05.2021. ORDER

This writ petition has been filed for the issuance of a Writ of Mandamus, directing the 1st respondent to survey and point out the field boundaries of the petitioner's agricultural land in Survey Nos.35/18, 35/15, 35/20 at Gonour West Village, Mettur Taluk, Salem District by fixing stones and subsequently directing the 2nd respondent to provide https://hcservices.ecourts.gov.in/hcservices/

necessary police protection at the time of survey and setting up the fencing to the petitioner's above said property in pursuant of the petitioner's representation dated 08.05.2021.

2. Heard Mr.C.Deepak Kumar, learned counsel appearing for the petitioner and Mr.P.Baladhandayutham, learned Special Government Pleader appearing for the respondents 1 & 2.

3. The petitioner submitted an application to survey and point out the field boundaries of the petitioner's agricultural land comprised in Survey Nos.35/18, 35/15, 35/20 situated at Gonour West Village, Mettur Taluk, Salem District before the first respondent.

The petitioner also paid requisite fee to measure the subject property.

4. Considering the above, the first respondent is directed to issue notice to the petitioner and the respondents 3 to 7 and after giving them an opportunity of hearing, pass order to survey the land. If the surveyor engaged by the first respondent to survey the land finds any hindrance while surveying the same, the concerned surveyor can very well seek police protection from the second respondent.

5. With the above direction, the writ petition is disposed of. No costs.
