The present criminal original petition has been filed to call for the records relating to Crl.M.P.No.3346 of 2015 on the file of the XIII Metropolitan Magistrate Court, Egmore [Allikulam], Chennai, dated 30.12.2015, set aside the same and grant police custody of the respondent/accused [A1] for a period of 5 days.

Today, when the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that the accused was granted bail by the Principal Sessions Judge, Chennai on 06.01.2016.

3. Since the respondent/ A1 was already released on bail, now, I am of the opinion that the question of considering the prayer in this petition does not arise at this stage and this petition is liable to be dismissed.

4. Accordingly, this Criminal Original Petition is dismissed.
