Respondent PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order of the respondent in No.TN/39375/PDC-3/Regl/03 dated 20.10.2003, quash the same and direct the respondent to waive damages and interest etc., for delayed contribution of Provident Fund and Miscellaneous Provisions Act.

O R D E R

The Writ Petition has been filed for a writ of certiorarified mandamus, challenging the order 20.10.2003 passed by the respondent and for consequential order to waive damages and interest under Section 14B of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952.

2. Today, when the matter was came up for hearing, the learned counsel appearing for the petitioner would submit that the entire amount claimed under the impugned order dated 20.10.2003 had been paid by the petitioner to the respondent by way of Demand Draft bearing No.511516 dated 09.10.2017 drawn on Indian Overseas Bank, Chennai for Rs.3,05,216/-, which has been acknowledged by the respondent on 13.10.2017 in their letter dated 12.10.2017. A copy of the same is also produced before https://hcservices.ecourts.gov.in/hcservices/

this Court. The learned counsel appearing for the respondent has also accepted the same and he has also made an endorsement to that effect.

3. In view of the same, nothing survives for adjudication in this matter. The Writ Petition stands disposed of accordingly. Connected Miscellaneous Petition is closed. No costs.
