The petitioner herein seeks a direction to the respondents to consider his representation dated 10.07.2024 seeking transfer of patta in his name.
2. According to the petitioner, the petitioner filed a suit for partition 1/4
against Munusamy and others in O.S.No.308 of 2008 on the file of the District Munsif Court, Krishnagiri and obtained a preliminary decree. Thereafter, the petitioner filed final decree petition in I.A.No.1185 of 2013 and final decree was also passed in his favour and allotted 1/10th share to him. The petitioner had taken possession of the property allotted to him through court. Thereafter, the petitioner submitted a representation before the respondents on 10.07.2024 seeking transfer of patta in respect of property allotted to him by virtue of final decree passed by the Civil Court. The said representation has not been considered by the respondents till date. Therefore, the petitioner is before this Court.
3. Mr.S.J.Sathik Mohamed, learned Government Advocate, who is taking notice for the respondents would submit that if petitioner submits an online application for transfer of patta, the same will be considered by the respondents on its own merit within the time fixed by this Court.
4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the petitioner to submit online application seeking transfer of patta within a period of two 2/4
weeks from the date of receipt of a copy of this order. If any such application is filed, the same shall be considered by the 2nd respondent and final orders shall be passed on its own merit, within a period of eight weeks from the date of receipt of online application.
5. With the above direction, the Writ Petition stands disposed of. No costs.
