M.P. No.5501 of 2022 passed by the Principal District and Sessions Judge, Chennai.

ORDER

This petition has been filed by the defacto complainant seeking to modify the condition imposed in the paragraph no.6 that "the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- with two sureties each for a like sum to the satisfaction of the learned V Metropolitan Magistate, Chennai and on deposit of Rs.5 lakhs to the credit of the Cr. No.623 of 2021 before the said Court..." in the order dated 08.04.2022 in Crl. M.P. No.5501 of 2021 passed by the Principal Sessions Court, Chennai.

2. When the matter was taken up for hearing, the learned counsel appearing for the petitioner represented that the Principal Sessions Court, Chennai passed a conditional order while granting bail to the accused, who is the 2nd respondent herein, that he has to deposit a sum of Rs.5 lakhs before the trial Court in the Cr. No.623 of 2021 and now the petitioner approached this Court to grant permission to take the said money deposited by the accused.

3. Admittedly, the petitioner has not approached the Principal Sessions Court, which passed the above said conditional order and straight away, she approached this Court. Hence, it is appropriate to direct the petitioner to approach the Principal Sessions Court to get appropriate remedy.

4. With the above directions, the criminal original petition is disposed of.
