Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of declaration declaring that the G.O.Ms.No.4 of School Education (X2) Department dated 19.01.2004 is not applicable to the vacancies arose prior to 01.06.2003 and appointments made prior to 01.06.2003 and consequently, cancel the order of the third respondent issued in Mu.Mu.No.499/B5/2003, dated 16.04.2004 and to direct the respondents to pay salary to the petitioner in the scale of pay of Secondary Grade Teacher from 10.01.2004 as per the approval order given by the third respondent on 10.03.2003.

ORDER

The relief sought for in this writ petition praying for issuance of a Writ of declaration declaring that the G.O.Ms.No.4 of School Education (X2) Department dated 19.01.2004 is not applicable to the vacancies arose prior to 01.06.2003 and appointments made prior to 01.06.2003 and consequently, cancel the order of the third respondent issued in Mu.Mu.No.499/B5/2003, dated 16.04.2004 and also to direct the respondents to pay salary to the petitioner in the scale of pay of Secondary Grade Teacher from 10.01.2004 as per the approval order given by the third respondent on 10.03.2003. 2.

The learned counsel appearing for the petitioner represented that the relief sought for by the petitioner has already been granted by the respondents. Mrs.K.Bhuvaneshwari, learned Government Advocate appearing on behalf of the respondents also affirmed the same. 3.
