This Civil Miscellaneous Petition has been filed to condone the delay of 380 days in filing the Appeal as against the Order dated 17.04.2023 made in MACTOP.No.2401 of 2019 on the file of the Motor Accident Claims Tribunal (II Additional Subordinate Judge, Coimbatore).

2. The learned Counsel for the Petitioner is present in Court.

3. The learned Counsel for the second Respondent who is present in Court has no objection provided that claim of interest for the period of 380 days is waived.

4. Accordingly, this Civil Miscellaneous Petition is allowed on condition that the Petitioner is not entitled to claim interest for the period of delay of 380 days.
