ORDER
The petitioner who was arrested and remanded to judicial custody on 06.05.2025 for the offence punishable under Section 303 (2) of BNS, 2023 in Cr.No.696 of 2024 registered on the file of the respondent, seeks bail.
2.The case of the prosecution is that the defacto-complainant is the driver of the vehicle bearing Registration No.TN 37 at 6701 which belonged to Sri Tirupathy Lorry Service. The defacto-complainant used to load the provisions in the said vehicle daily morning and deliver it to the shops at Coimbatore and then he would go to the lorry office at Thomas Street, Coimbatore and will give the lorry rent to the owner. On 01.12.2024, at about 10.00 hours, defacto-complainant had gone and checked, the said vehicle was parked in the vacant land. Thereafter, on 02.12.2024, at about 9.00 hours, the said vehicle was found missing. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that petitioner is in judicial custody from 06.05.2025 and hence further custody of the petitioner is not required. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that petitioner is having 22 previous case pending. Further this case is taken on file in C.C.No.257 of 2025 and posted for examination of Investigation Officer and the case is likely to be completed within a short period of time. Hence, opposed for grant of bail to the petitioner.
5.Heard the learned counsels on either side and perused the materials on record. 6.Considering the facts and circumstances of the case, the fact that the petitioner is having 22 previous cases and since custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 23-07-2025 ep To
