ORDER
(The case has been heard through Video Conference) This Criminal Revision Case is filed against the order passed in Crl.M.P.No.1799 of 2017, by the learned Fast Track Court No.II, Metropolitan Magistrate Court, Egmore at Allikulam, Chennai - 3, dated 11.08.2017.
2.The respondent herein/complainant has filed a case in C.C.No.2486 of 2016, before the Fast Track Court No.II, Metropolitan Magistrate Court, Egmore at Allikulam, Chennai - 8, for the offence under Section 138 of the Negotiable Instruments Act. During the pendency of the above said C.C. a petition was filed by the respondent herein/complainant in Crl.M.P.No.1799 of 2017, to substitute the new representative viz., K.Rajangam in the place of earlier representative viz., M.Saravanan, and the same was allowed. Hence, the present Criminal Revision Case has been filed by the accused before this Court.
3.Heard both the learned counsels and perused the materials placed on record.
4.During the pending of this Criminal Revision Case compromise was arrived at by the revision petitioner/accused and a memo has been filed on behalf of the petitioners/accused to that effect, wherein revision petitioner/accused agreed to pay a sum of Rs.4,40,000/- as one time settlement, out of which, a sum of Rs.3,40,000/- has already been paid and another sum of Rs.25,000/- has been paid by way of G-pay in the name of the respondent/complainant and the balance amount of Rs.75,000/- is to be paid. Further, it is seen from the memo that before the Trial Court for reporting settlement the matter was posted on 19.01.2022.
5.The learned counsel for the respondent herein/complainant would state that the entire amount has not been paid and that this revision case is only against the order passed in Crl.M.P.No.1799 of 2017, for payment of balance amount.
6.In view of the subsequent development, this Court finds that no further order is necessary in this case. Accordingly, this Criminal Revision Case stands closed. Since the matter
posted on 19.01.2022, for arguments or for reporting settlement before the Trial Court, both the parties are directed to appear before the Trial Court on that day.
7.With the above observations and direction, this Criminal Revision Case stands closed. Consequently, connected miscellaneous petition is closed.
