The father of the minor children has presented this application for permission to speak with the minor child Vihan, who is in the custody of the respondent.

2. At the last hearing, learned counsel were directed to obtain instructions as to a convenient date and time for the said purpose. Learned counsel for the respondent submits that the application, as framed, is designed to impede the effective prosecution of proceedings pending before the Family Court, Kerala. He also submits that the respondent denies all allegations made in the affidavit. Without prejudice, he submits that the respondent is agreeable to provide access to the child in her custody every Saturday for 30 minutes between 8.00 and 8.30 P.M on condition that similar access be provided to the respondent as regards the child in the custody of the applicant.

3. Learned counsel for the applicant submits that parties had agreed to provide such video call access on two days of the week.

4. At this juncture, parties are in agreement to provide video call access on one day of the week. Therefore, this application is disposed of with the following directions:

(i) The applicant and the respondent shall provide access through video call to the minor child in the custody of the other parent between 8.00 and 8.30 P.M on every Saturday.

(ii) This arrangement shall continue until further orders. (iii) It is not left open to parties to re-apply, if necessary.

5. List the O.P on 02.02.2023.
