This civil miscellaneous petition has been filed to condone the delay of 166 days in filing the above CRP against the fair and decretal order dated 29.08.2016 made in I.A.No.261 of 2016 in O.S.No.265 of 2008 on the file of the District Munsif Court, Dharmapuri.

2.Heard Mr.C.Munusamy, learned counsel appearing for the petitioner and Mr.S.Ravi, learned counsel appearing for the respondent. 3.The learned counsel appearing for the respondent wants time to file counter, otherwise for the prejudice caused to the respondent, he may be compensated by way of cost.

4.Considering the said submissions made by the learned counsel appearing for the respondent, this Court, after having gone through the reasons stated in the affidavit filed in support of this miscellaneous petition, is inclined to accept the same, of course, on terms.

C.M.P.No.9227 of 2017 in C.R.P.SR.No.43624 of 2017 Sgl 5.Accordingly, this condone delay petition is ordered and the delay is condoned on condition that, the petitioner shall pay a sum of Rs.2,000/- (Rupees two thousand) as costs to the respondent, which shall be paid within a period of one week from the date of receipt of a copy of this order, to the learned counsel appearing for the respondent directly.
