Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus to direct the respondents to sanction and disburse the subsistence allowance due to the petitioner for the period from 01.07.2017 to till date within a reasonable time frame.

As per the request, the Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that the petitioner was appointed as Village Administrative Officer in Namakkal District on 19.02.2005. The

petitioner successfully completed his probation and has become full member of service. The petitioner who was due for superannuation on 30.06.2017 was suspended and not allowed to retire from service based on the orders issued by the Government in letter No.23983/SCR7(2)/2017, Revenue Department dated 30.06.2017. Therefore, the petitioner made a representation dated 09.11.2017 to direct the respondents to sanction and disburse the subsistence allowance due to the petitioner for the period from 01.07.2017 to till date within a reasonable time frame, but till date his representation has not been considered by the respondents. Aggrieved by the same, the petitioner has filed the above writ petition.

The learned counsel for the petitioner would further submit that it would be suffice to issue a direction to the respondents to dispose of the representation in accordance with law.

Without expressing any opinion, I am inclined to issue direction to the respondents to consider the petitioner's representation dated 09.11.2017 and dispose of the same in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
