ORDER
By this writ petition, the petitioner seeks a direction for payment of the entire retirement benefits, including attendant benefits along with interest thereon at 18% per annum.
2. Learned counsel for the petitioner refers to order dated 28.06.2022 and points out that retirement benefits were withheld on account of the pendency of W.P.No.2013 of 2021. By relying on order dated 10.12.2018 in W.P.No.32638 of 2018, R.Ganesan v. The Managing Director, Tamil 2/5
Nadu State Transport Corporation, he contends that his retirement benefits should not have been withheld merely on account of the pendency of such writ petition.
3. Learned standing counsel for the Corporation submits that W.P.No.2013 of 2021 was disposed of and that, consequently, there is no impediment for the payment of amounts due and payable to the petitioner. He seeks four weeks time to compute and make such payment. Learned counsel for the petitioner submits that interest should be paid on belated payments at 18% per annum. By taking account the inflation rate, prevalent interest rates and other relevant factors, I conclude that it is just and appropriate that belated payments shall carry interest at the rate of 9% per annum.
4. Therefore, W.P.No.26690 of 2022 is disposed of by directing the respondent to make outstanding payments to the petitioner within a maximum period of four weeks from today. Such payment shall be made 3/5
along with interest at the rate of 9% per annum or at the rate, if any, fixed in applicable statutes on all delayed payments. No costs. 03.09.2025 rna Index : Yes / No Internet : Yes / No 4/5
