ORDER

The petitioner who was arrested and remanded to judicial custody on 21.06.2025 for the offence punishable under Section 408 I.P.C. in Cr.No.6 of 2025 registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that the defacto-complainant is working as VP Tech in Shanthi Casting Works. The said company is engaged in manufacturing of graded 1, S.G.Rough and Mechanized iron casting. For the manufacture of the above said materials,the defacto-complainant company had purchased a part of INSERT and after using the same, sold the same in whole sale basis. The purchased material has been stored in Main store and subsequently the same has been handed over for production. Further the used insert material has also been stored in Main Store and the same has been sold subsequently. The petitioner is the incharge of the said main store and he joined duty on 01.06.2002.

While so, in the end of March - 2023, while verifying the registers regarding the stocks of used inserts for the purpose of selling the same, the petitioner was asked to bring the registers. The petitioner continuously evaded the same. While so, from 05.04.2023, the petitioner has not come to the office. On suspicion, while verifying the registers, it came to know that 2075 kgs of used inserts were found missing from the main store. After knowing the same, when enquired with the petitioner, he has not given proper explanation. Subsequently while enquiring with the customers of the defacto-complainant company, it came to know that the petitioner had misappropriated a sum of Rs.57,81,218/-.

Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that petitioner is in judicial custody from 21.06.2025 and hence further custody of the petitioner is not required. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that 2075 kg of Insert part used in the casting has been misappropriated and converted into cash and caused loss to the tune of Rs.60,00,000/-. Hence, opposed for grant of bail to the petitioner.

5.Heard the learned counsels on either side and perused the materials on record. 6.Considering the facts and circumstances of the case, the nature of offence, and since custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 23-07-2025
