This petition is filed to condone the delay of 78 days in filing the above appeal.

2. Learned counsel appearing for the petitioner submitted that the 1st respondent remained exparte before the Tribunal and notice to the 1st respondent is not necessary.

3. Though notice has been served on the 2nd respondent and his name is printed in the cause list, there is no representation for him either in person or through counsel.

4. Heard learned counsel appearing for the petitioner and perused the materials available on record.

5. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 78 days is condoned and the petition is ordered.
