The application to condone delay of 2554 days in preferring the first appeal in C.M.P.No.18762 of 2024 in A.S.SR.No.101845 of 2024 came to be dismissed by this Court on the ground of non-prosecution on 10.06.2025. Subsequently, learned counsel for the petitioner filed the present petition in C.M.P.No.26167 of 2025 within seven days, seeking the restoration of C.M.P.No.18762 of 2024.
2. I have gone through the affidavit filed in support of the said application and heard learned counsel for the petitioner, and I am satisfied with the reasons assigned by the petitioner for not being able to represent the matter on the date of dismissal of C.M.P.No.18762 of 2024.
3. Accordingly, C.M.P.No.26167 of 2025 is ordered. C.M.P.No.18762 of 2024 is hereby restored to file and the Registry is directed to list the matter on 06.02.2026.
