ORDER

This petition has been filed to enlarge the petitioners on bail in the event of their arrest in Crime No.8 of 2025 on the file of the Inspector of Police, W-32 All Women Police Station, Madipakkam, Chennai.

2. The case of the prohibition is that at the inducement of the second petitioner, first petitioner kicked the defacto complainant due to which she aborted. Hence, FIR registered under Section 85 of BNS Act.

3. The learned counsel for the petitioners submit that out of love affair, the first petitioner married the defacto complainant, who were live together near the defato complainant's parent's house. After completion of 2 months from the marriage there was a quarrel picked up between the first petitioner and his parents. When the first petitioner raised objections, the defacto complainant attacked with wooden log and subsequently she fell down on her own. Hence,

he prays to grant bail to the petitioners.

4. The learned Government Advocate submits that it is a family dispute between parties.

5. Considering the facts and circumstances of the case and also the fact that there was family dispute between the parties. Hence, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the Additional Mahila Court, Alandur, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:

[a] the petitioners and the sureties shall affix their photographs and Left

Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioners are directed to report before the respondent police as and when required for interrogation. Further, this Court is inclined to appoint Ms.D.B. Kalaichelve as Mediator. Both the petitioners and the defacto complainant is directed to appear before the mediator.

[c] the petitioner shall not tamper with evidence or witness either during investigation or trial. [d] the petitioner shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
